제92조 연금보험료의 추후 납부

가입자는 10년 미만의 범위에서 다음 각 호의 어느 하나에 해당하는 기간의 전부 또는 일부에 상응하는 연금보험료(이하 "추납보험료"라 한다)의 추후 납부를 신청할 수 있다. <개정 2017.10.24, 2020.12.29, 2023.3.28>
1. 연금보험료를 최초로 납부한 이후에 제9조제1호, 제4호 또는 제5호에 따라 연금보험료를 내지 아니한 기간
1의2. 18세 미만 근로자가 제8조제2항 본문에 따라 연금보험료를 최초로 납부한 이후에 같은 항 단서에 따라 연금보험료를 내지 아니한 기간
2. 제91조제1항에 따라 연금보험료를 내지 아니한 기간
3. 「병역법」 제3조에 따른 병역의무를 마친 후 가입자의 자격을 취득한 경우로서 해당 병역의무를 수행한 기간. 다만, 다음 각 목의 어느 하나에 해당하는 기간은 제외한다.
- 가. 「공무원연금법」, 「사립학교교직원 연금법」 또는 「별정우체국법」에 따른 재직기간에 포함된 기간
- 나. 「군인연금법」에 따른 복무기간에 포함된 기간
- 다. 1988년 1월 1일 전에 병역의무를 수행한 기간
A subscriber may apply for the retroactive payment of pension insurance premiums (hereinafter referred to as "retroactive payment premiums") corresponding to all or part of the period falling under any of the following subparagraphs, within the scope of less than 10 years: <Amended by Act No. 14477, Oct. 24, 2017; Act No. 17797, Dec. 29, 2020; Act No. 19285, Mar. 28, 2023> 1. Period after the initial payment of pension insurance premiums during which pension insurance premiums were not paid pursuant to Article 9 (1), (4), or (5). 1-2. Period after the initial payment of pension insurance premiums by a worker under 18 years of age pursuant to the main sentence of Article 8 (2), during which pension insurance premiums were not paid pursuant to the proviso of the same paragraph. 2. Period during which pension insurance premiums were not paid pursuant to Article 91 (1). 3. Period of military service performed by a subscriber who acquired eligibility after completing military service obligations as prescribed by Article 3 of the Military Service Act. However, the following periods shall be excluded: a. Periods included in the period of service under the 「Act on the Military Personnel Pension」, the 「Act on the Pension for School Teachers of Private Schools」, or the 「Act on Special Postal Offices」. b. Periods included in the period of service under the 「Act on the Military Pension for Soldiers」. c. Periods of military service performed before January 1, 1988.
납부한 연금보험료를 반환일시금으로 지급받은 경우에는 제1항제1호 및 제1호의2에도 불구하고 그에 상응하는 기간은 연금보험료를 납부한 것으로 보지 아니한다. 다만, 지급받은 반환일시금을 제78조에 따라 반납금으로 납부한 경우에는 그러하지 아니하다. <신설 2017.10.24, 2023.3.28>
Notwithstanding subparagraphs 1 and 1-2 of paragraph ①, if the paid pension insurance premiums have been paid as a lump-sum refund, the corresponding period shall not be considered as having paid pension insurance premiums. However, this shall not apply if the received lump-sum refund is paid as a repayment under Article 78. <Newly Inserted by Act No. 14477, Oct. 24, 2017; Act No. 19285, Mar. 28, 2023>
추납보험료는 제6항에 따른 납부 기한이 속하는 달의 연금보험료에 추후 납부하려는 기간의 개월 수를 곱한 금액으로 하되, 그 연금보험료 계산을 위한 기준소득월액은 추후 납부를 신청한 날이 속하는 달을 기준으로 한다. 다만, 임의가입자가 추후 납부를 신청한 경우 그 추납보험료 산정을 위한 연금보험료의 상한은 대통령령으로 정한다. <개정 2017.10.24, 2025.11.25>
The retroactive payment premiums shall be calculated by multiplying the monthly pension insurance premium for the month in which the payment deadline prescribed by paragraph ⑥ falls by the number of months in the period for which retroactive payment is requested; provided, that the standard monthly income for calculating such pension insurance premium shall be based on the month in which the date of application for retroactive payment falls. However, if an optional subscriber applies for retroactive payment, the upper limit of pension insurance premiums for calculating such retroactive payment premiums shall be determined by Presidential Decree. <Amended by Act No. 14477, Oct. 24, 2017; Act No. 2023.11.25>
추납보험료는 대통령령으로 정하는 바에 따라 분할하여 납부할 수 있다. 이 경우 대통령령으로 정하는 이자를 더하여야 한다. <개정 2017.10.24>
The retroactive payment premiums may be paid in installments as prescribed by Presidential Decree. In this case, interest as prescribed by Presidential Decree shall be added. <Amended by Act No. 14477, Oct. 24, 2017>
추납보험료를 낸 경우 그에 상응하는 기간은 제1항에 따라 추납보험료를 납부한 날을 기준으로 가입기간에 산입한다. 이 경우 추후 납부에 따라 산입되는 가입기간의 기본연금액은 추납보험료를 납부한 날이 속하는 달을 기준으로 산정한다. <개정 2017.10.24>
When retroactive payment premiums are paid, the corresponding period shall be included in the period of subscription, based on the date of payment of the retroactive payment premiums under paragraph ①. In this case, the basic pension amount for the period of subscription included due to retroactive payment shall be calculated based on the month in which the date of payment of the retroactive payment premiums falls. <Amended by Act No. 14477, Oct. 24, 2017>
제1항부터 제5항까지에서 규정한 사항 외에 추납보험료의 납부 신청, 납부 방법 및 납부 기한 등 추납보험료의 납부에 필요한 사항은 대통령령으로 정한다. <개정 2017.10.24>
Matters necessary for the payment of retroactive payment premiums, such as application for payment, method of payment, and payment deadline, other than those prescribed in paragraphs ① through ⑤, shall be determined by Presidential Decree. <Amended by Act No. 14477, Oct. 24, 2017>
