제110조 물질안전보건자료의 작성 및 제출

화학물질 또는 이를 포함한 혼합물로서 제104조에 따른 분류기준에 해당하는 것(대통령령으로 정하는 것은 제외한다. 이하 "물질안전보건자료대상물질"이라 한다)을 제조하거나 수입하려는 자는 다음 각 호의 사항을 적은 자료(이하 "물질안전보건자료"라 한다)를 고용노동부령으로 정하는 바에 따라 작성하여 고용노동부장관에게 제출하여야 한다. 이 경우 고용노동부장관은 고용노동부령으로 물질안전보건자료의 기재 사항이나 작성 방법을 정할 때 「화학물질관리법」 및 「화학물질의 등록 및 평가 등에 관한 법률」과 관련된 사항에 대해서는 기후에너지환경부장관과 협의하여야 한다. <개정 2020.5.26, 2025.10.1>

Any person who intends to manufacture or import chemical substances or mixtures containing them that fall under the classification criteria pursuant to Article 104 (excluding those prescribed by Presidential Decree; hereinafter referred to as "substances subject to material safety data sheets") shall prepare and submit to the Minister of Employment and Labor a document stating the matters listed in the following subparagraphs (hereinafter referred to as "material safety data sheets"), in accordance with the Ordinance of the Ministry of Employment and Labor. In this case, when determining the matters to be entered in the material safety data sheets or the method of preparation in the Ordinance of the Ministry of Employment and Labor, the Minister of Employment and Labor shall consult with the Minister of Trade, Industry and Energy regarding matters related to the 「Act on the Registration and Evaluation, etc. of Chemical Substances」 and the 「Chemicals Control Act」. <Amended by 2020.5.26, 2025.10.1> 1. Product name 2. Name and content of chemical substances among those constituting the substances subject to material safety data sheets that fall under the classification criteria pursuant to Article 104 3. Precautions for safe handling and health 4. Hazards to health and the environment, and physical hazards 5. Physical and chemical properties, and other matters prescribed by the Ordinance of the Ministry of Employment and Labor
물질안전보건자료대상물질을 제조하거나 수입하려는 자는 물질안전보건자료대상물질을 구성하는 화학물질 중 제104조에 따른 분류기준에 해당하지 아니하는 화학물질의 명칭 및 함유량을 고용노동부장관에게 별도로 제출하여야 한다. 다만, 다음 각 호의 어느 하나에 해당하는 경우는 그러하지 아니하다.
1. 제1항에 따라 제출된 물질안전보건자료에 이 항 각 호 외의 부분 본문에 따른 화학물질의 명칭 및 함유량이 전부 포함된 경우
2. 물질안전보건자료대상물질을 수입하려는 자가 물질안전보건자료대상물질을 국외에서 제조하여 우리나라로 수출하려는 자(이하 "국외제조자"라 한다)로부터 물질안전보건자료에 적힌 화학물질 외에는 제104조에 따른 분류기준에 해당하는 화학물질이 없음을 확인하는 내용의 서류를 받아 제출한 경우
Any person who intends to manufacture or import substances subject to material safety data sheets shall separately submit to the Minister of Employment and Labor the names and contents of chemical substances constituting the substances subject to material safety data sheets that do not fall under the classification criteria pursuant to Article 104. Provided, That this shall not apply to cases falling under any of the following subparagraphs: 1. Where the names and contents of the chemical substances referred to in the main clause of the respective subparagraphs of this paragraph are entirely included in the material safety data sheets submitted pursuant to paragraph ① 2. Where a person who intends to import substances subject to material safety data sheets has received and submitted a document from the person who manufactures substances subject to material safety data sheets outside the country and exports them to Korea (hereinafter referred to as "foreign manufacturer") to the effect that there are no chemical substances falling under the classification criteria pursuant to Article 104 other than those stated in the material safety data sheets.
물질안전보건자료대상물질을 제조하거나 수입한 자는 제1항 각 호에 따른 사항 중 고용노동부령으로 정하는 사항이 변경된 경우 그 변경 사항을 반영한 물질안전보건자료를 고용노동부장관에게 제출하여야 한다.
Any person who has manufactured or imported substances subject to material safety data sheets shall submit to the Minister of Employment and Labor material safety data sheets reflecting any changes in the matters prescribed by the Ordinance of the Ministry of Employment and Labor among those listed in the subparagraphs of paragraph ①, if such changes have occurred.
제1항부터 제3항까지의 규정에 따른 물질안전보건자료 등의 제출 방법ㆍ시기, 그 밖에 필요한 사항은 고용노동부령으로 정한다.
The method and timing of submission of material safety data sheets, etc. pursuant to paragraphs ① through ③, and other necessary matters shall be prescribed by the Ordinance of the Ministry of Employment and Labor.
