제113조 국외제조자가 선임한 자에 의한 정보 제출 등

국외제조자는 고용노동부령으로 정하는 요건을 갖춘 자를 선임하여 물질안전보건자료대상물질을 수입하는 자를 갈음하여 다음 각 호에 해당하는 업무를 수행하도록 할 수 있다. <개정 2023.8.8>
1. 제110조제1항 또는 제3항에 따른 물질안전보건자료의 작성ㆍ제출
2. 제110조제2항 각 호 외의 부분 본문에 따른 화학물질의 명칭 및 함유량 또는 같은 항 제2호에 따른 확인서류의 제출
3. 제112조제1항에 따른 대체자료 기재 승인, 같은 조 제5항에 따른 유효기간 연장승인 또는 제112조의2에 따른 이의신청
An overseas manufacturer may appoint a person who meets the requirements prescribed by the Ordinance of the Ministry of Employment and Labor to perform the following duties in lieu of the importer of materials subject to the Material Safety Data Sheet: 1. Preparation and submission of the Material Safety Data Sheet pursuant to Article 110(1) or (3) 2. Submission of the name and content of chemical substances pursuant to the main clause of Article 110(2) excluding the subparagraphs, or submission of the confirmation documents pursuant to Article 110(2)2. 3. Approval for the description of alternative data pursuant to Article 112(1), approval for the extension of the validity period pursuant to Article 112(5), or application for objection pursuant to Article 112의2.
제1항에 따라 선임된 자는 고용노동부장관에게 제110조제1항 또는 제3항에 따른 물질안전보건자료를 제출하는 경우 그 물질안전보건자료를 해당 물질안전보건자료대상물질을 수입하는 자에게 제공하여야 한다.
A person appointed pursuant to paragraph ① shall provide the Material Safety Data Sheet to the importer of materials subject to the Material Safety Data Sheet when submitting the Material Safety Data Sheet pursuant to Article 110(1) or (3) to the Minister of Employment and Labor.
제1항에 따라 선임된 자는 고용노동부령으로 정하는 바에 따라 국외제조자에 의하여 선임되거나 해임된 사실을 고용노동부장관에게 신고하여야 한다.
A person appointed pursuant to paragraph ① shall report to the Minister of Employment and Labor the fact of being appointed or dismissed by the overseas manufacturer, as prescribed by the Ordinance of the Ministry of Employment and Labor.
제2항에 따른 물질안전보건자료의 제출 및 제공 방법ㆍ내용, 제3항에 따른 신고 절차ㆍ방법, 그 밖에 필요한 사항은 고용노동부령으로 정한다.
The method and content of submission and provision of the Material Safety Data Sheet pursuant to paragraph ②, the procedures and method of reporting pursuant to paragraph ③, and other necessary matters shall be prescribed by the Ordinance of the Ministry of Employment and Labor.
