제141조 역학조사

고용노동부장관은 직업성 질환의 진단 및 예방, 발생 원인의 규명을 위하여 필요하다고 인정할 때에는 근로자의 질환과 작업장의 유해요인의 상관관계에 관한 역학조사(이하 "역학조사"라 한다)를 할 수 있다. 이 경우 사업주 또는 근로자대표, 그 밖에 고용노동부령으로 정하는 사람이 요구할 때 고용노동부령으로 정하는 바에 따라 역학조사에 참석하게 할 수 있다.
The Minister of Employment and Labor may conduct an epidemiological investigation (hereinafter referred to as "epidemiological investigation") on the correlation between workers' illnesses and hazardous factors in the workplace when deemed necessary for the diagnosis and prevention of occupational diseases and the identification of the causes of their occurrence. In this case, when requested by the employer, the workers' representative, or any other person prescribed by the Ministry of Employment and Labor Ordinance, the Minister may allow them to attend the epidemiological investigation in accordance with the provisions of the Ministry of Employment and Labor Ordinance.
사업주 및 근로자는 고용노동부장관이 역학조사를 실시하는 경우 적극 협조하여야 하며, 정당한 사유 없이 역학조사를 거부ㆍ방해하거나 기피해서는 아니 된다.
Employers and workers shall actively cooperate when the Minister of Employment and Labor conducts an epidemiological investigation, and shall not refuse, obstruct, or evade the epidemiological investigation without justifiable grounds.
누구든지 제1항 후단에 따라 역학조사 참석이 허용된 사람의 역학조사 참석을 거부하거나 방해해서는 아니 된다.
No person shall refuse or obstruct the attendance of a person permitted to attend an epidemiological investigation under the latter part of Paragraph ①.
제1항 후단에 따라 역학조사에 참석하는 사람은 역학조사 참석과정에서 알게 된 비밀을 누설하거나 도용해서는 아니 된다.
A person attending an epidemiological investigation under the latter part of Paragraph ① shall not disclose or misuse any secret learned during the attendance of the epidemiological investigation.
고용노동부장관은 역학조사를 위하여 필요하면 제129조부터 제131조까지의 규정에 따른 근로자의 건강진단 결과, 「국민건강보험법」에 따른 요양급여기록 및 건강검진 결과, 「고용보험법」에 따른 고용정보, 「암관리법」에 따른 질병정보 및 사망원인 정보 등을 관련 기관에 요청할 수 있다. 이 경우 자료의 제출을 요청받은 기관은 특별한 사유가 없으면 이에 따라야 한다.
The Minister of Employment and Labor may, if necessary for an epidemiological investigation, request workers' health examination results under Articles 129 to 131, records of medical care benefits and health examination results under the National Health Insurance Act, employment information under the Employment Insurance Act, disease information and causes of death information under the Cancer Control Act, etc., from relevant agencies. In this case, the agency from which the submission of data is requested shall comply unless there is a special reason.
역학조사의 방법ㆍ대상ㆍ절차, 그 밖에 필요한 사항은 고용노동부령으로 정한다.
The methods, subjects, procedures, and other necessary matters of epidemiological investigations shall be prescribed by the Ministry of Employment and Labor Ordinance.
