Article 19 (Person in Charge of Safety and Health Management)

사업주는 사업장에 안전 및 보건에 관하여 사업주를 보좌하고 관리감독자에게 지도ㆍ조언하는 업무를 수행하는 사람(이하 "안전보건관리담당자"라 한다)을 두어야 한다. 다만, 안전관리자 또는 보건관리자가 있거나 이를 두어야 하는 경우에는 그러하지 아니하다.
The employer shall appoint a person (hereinafter referred to as the "person in charge of safety and health management") who assists the employer and provides guidance and advice to the supervisor regarding safety and health at the workplace. However, this shall not apply if a safety manager or health manager is appointed or is required to be appointed.
안전보건관리담당자를 두어야 하는 사업의 종류와 사업장의 상시근로자 수, 안전보건관리담당자의 수ㆍ자격ㆍ업무ㆍ권한ㆍ선임방법, 그 밖에 필요한 사항은 대통령령으로 정한다.
The types of businesses and the number of regular workers at workplaces that are required to appoint a person in charge of safety and health management, the number, qualifications, duties, authority, and appointment method of the person in charge of safety and health management, and other necessary matters shall be determined by Presidential Decree.
고용노동부장관은 산업재해 예방을 위하여 필요한 경우로서 고용노동부령으로 정하는 사유에 해당하는 경우에는 사업주에게 안전보건관리담당자를 제2항에 따라 대통령령으로 정하는 수 이상으로 늘리거나 교체할 것을 명할 수 있다.
The Minister of Employment and Labor may order an employer to increase the number of persons in charge of safety and health management to more than the number determined by Presidential Decree under paragraph ②, or to replace them, if it is necessary for the prevention of industrial accidents and falls under the reasons prescribed by the Ordinance of the Ministry of Employment and Labor.
대통령령으로 정하는 사업의 종류 및 사업장의 상시근로자 수에 해당하는 사업장의 사업주는 안전관리전문기관 또는 보건관리전문기관에 안전보건관리담당자의 업무를 위탁할 수 있다.
The employer of a workplace falling under the types of businesses and the number of regular workers at workplaces prescribed by Presidential Decree may entrust the duties of the person in charge of safety and health management to a specialized safety management agency or a specialized health management agency.
