제38조 안전조치

사업주는 다음 각 호의 어느 하나에 해당하는 위험으로 인한 산업재해를 예방하기 위하여 필요한 조치를 하여야 한다.
1. 기계ㆍ기구, 그 밖의 설비에 의한 위험
2. 폭발성, 발화성 및 인화성 물질 등에 의한 위험
3. 전기, 열, 그 밖의 에너지에 의한 위험
An employer shall take necessary measures to prevent industrial accidents caused by the dangers listed in any of the following subparagraphs. 1. Dangers from machinery, equipment, or other facilities 2. Dangers from explosive, ignitable, or flammable substances, etc. 3. Dangers from electricity, heat, or other energy
사업주는 굴착, 채석, 하역, 벌목, 운송, 조작, 운반, 해체, 중량물 취급, 그 밖의 작업을 할 때 불량한 작업방법 등에 의한 위험으로 인한 산업재해를 예방하기 위하여 필요한 조치를 하여야 한다.
When carrying out excavation, quarrying, loading/unloading, logging, transportation, operation, conveyance, dismantling, handling of heavy objects, or other work, an employer shall take necessary measures to prevent industrial accidents caused by dangers from improper work methods, etc.
사업주는 근로자가 다음 각 호의 어느 하나에 해당하는 장소에서 작업을 할 때 발생할 수 있는 산업재해를 예방하기 위하여 필요한 조치를 하여야 한다.
1. 근로자가 추락할 위험이 있는 장소
2. 토사ㆍ구축물 등이 붕괴할 우려가 있는 장소
3. 물체가 떨어지거나 날아올 위험이 있는 장소
4. 천재지변으로 인한 위험이 발생할 우려가 있는 장소
An employer shall take necessary measures to prevent industrial accidents that may occur when workers perform work in any of the following places. 1. Places where there is a risk of workers falling 2. Places where there is a risk of soil, structures, etc. collapsing 3. Places where there is a risk of objects falling or flying 4. Places where there is a risk of danger due to natural disasters
사업주가 제1항부터 제3항까지의 규정에 따라 하여야 하는 조치(이하 "안전조치"라 한다)에 관한 구체적인 사항은 고용노동부령으로 정한다.
The specific details concerning the measures that an employer shall take in accordance with paragraphs ① through ③ (hereinafter referred to as "safety measures") shall be prescribed by the Ordinance of the Ministry of Employment and Labor.
