Article 56-2 (Preparation and Disclosure of Disaster Investigation Report)
제56조의2 재해조사보고서의 작성ㆍ공개

공단 또는 관계전문가는 제56조제2항에 따른 원인조사를 실시하는 경우 중대재해등의 발생 원인과 재발방지 대책 등을 포함한 보고서(이하 이 조에서 "재해조사보고서"라 한다)를 작성하여 고용노동부장관에게 제출하여야 한다.
The Corporation or related experts, when conducting an investigation into the cause pursuant to Article 56, Paragraph 2, shall prepare a report (hereinafter referred to as the "Disaster Investigation Report" in this Article) including the cause of the occurrence of a serious disaster, etc., and measures to prevent recurrence, and submit it to the Minister of Employment and Labor.
고용노동부장관은 동종ㆍ유사 재해의 예방을 위하여 재해조사보고서를 해당 사건에 대한 공소가 제기된 이후에 공개한다. 다만, 수사나 재판의 대상이 아닌 경우 등 고용노동부령으로 정하는 사유에 해당하는 때에는 공소 제기 여부와 관계없이 공개할 수 있다.
The Minister of Employment and Labor shall disclose the Disaster Investigation Report after the indictment for the relevant case has been filed, in order to prevent similar or analogous disasters. Provided, however, that disclosure may be made regardless of whether an indictment has been filed in cases falling under the reasons prescribed by the Ordinance of the Ministry of Employment and Labor, such as when it is not the subject of an investigation or trial.
제2항에 따라 재해조사보고서를 공개하는 경우 「공공기관의 정보공개에 관한 법률」 제9조제1항제2호, 제6호 또는 제7호에 해당하는 사항은 공개 대상에서 제외할 수 있다.
When disclosing the Disaster Investigation Report pursuant to Paragraph 2, matters falling under Article 9, Paragraph 1, Subparagraphs 2, 6, or 7 of the Act on Disclosure of Information by Public Institutions may be excluded from the scope of disclosure.
제1항에 따른 재해조사보고서의 작성 내용, 제2항에 따른 재해조사보고서의 공개 방법ㆍ절차 및 그 밖에 필요한 사항은 고용노동부령으로 정한다.
The contents of the Disaster Investigation Report pursuant to Paragraph 1, the methods and procedures for disclosing the Disaster Investigation Report pursuant to Paragraph 2, and other necessary matters shall be prescribed by the Ordinance of the Ministry of Employment and Labor.
