제47조 폐기물의 회수 조치

사업자는 제품의 제조ㆍ가공ㆍ수입 또는 판매 등을 할 때에 그 제조ㆍ가공ㆍ수입 또는 판매 등에 사용되는 재료ㆍ용기ㆍ제품 등이 폐기물이 되는 경우 그 회수와 처리가 쉽도록 하여야 한다.
A business operator shall make it easy to recover and dispose of materials, containers, products, etc. used in the manufacture, processing, import, or sale of products, when they become waste.
사업자는 제1항에 따른 재료ㆍ용기ㆍ제품 등이 「대기환경보전법」 제2조, 「물환경보전법」 제2조 및 「화학물질관리법」 제2조에 따른 대기오염물질, 수질오염물질, 인체급성유해성물질, 인체만성유해성물질, 생태유해성물질 중 기후에너지환경부령으로 정하는 물질을 포함하고 있거나 다량으로 제조ㆍ가공ㆍ수입 또는 판매되어 폐기물이 되는 경우 기후에너지환경부장관이 고시하는 폐기물의 회수 및 처리방법에 따라 회수ㆍ처리하여야 한다. 이 경우 기후에너지환경부장관이 이를 고시하려면 미리 관계 중앙행정기관의 장과 협의하여야 한다. <개정 2007.5.17, 2013.6.4, 2017.1.17, 2020.5.26, 2024.2.6, 2025.10.1>
If materials, containers, products, etc. under paragraph ① contain substances designated by the Ordinance of the Ministry of Climate, Energy and Environment among air pollutants, water pollutants, acute human toxic substances, chronic human toxic substances, and ecotoxic substances under Article 2 of the 「Atmospheric Environment Conservation Act」, Article 2 of the 「Water Environment Conservation Act」, and Article 2 of the 「Chemicals Control Act」, or if they are manufactured, processed, imported, or sold in large quantities and become waste, the business operator shall recover and dispose of them according to the waste recovery and disposal methods publicly announced by the Minister of Climate, Energy and Environment. In this case, before publicly announcing them, the Minister of Climate, Energy and Environment shall consult with the heads of the relevant central administrative agencies.
기후에너지환경부장관은 사업자가 제2항에 따라 고시된 회수ㆍ처리방법에 따라 회수ㆍ처리하지 아니하면 기간을 정하여 그 회수와 처리에 필요한 조치를 할 것을 권고할 수 있다. <개정 2025.10.1>
If a business operator does not recover and dispose of waste according to the recovery and disposal methods publicly announced under paragraph ②, the Minister of Climate, Energy and Environment may recommend the necessary recovery and disposal measures within a specified period.
기후에너지환경부장관은 제3항에 따라 권고를 받은 자가 권고사항을 이행하지 아니하면 해당 폐기물의 회수와 적정한 처리 등에 필요한 조치를 명할 수 있다. <개정 2025.10.1>
If a person who has received a recommendation under paragraph ③ does not comply with the recommended measures, the Minister of Climate, Energy and Environment may order the necessary measures for the recovery and proper disposal of the relevant waste.
