제36조 보수월액의 결정 등

공단은 제35조에 따라 통보받은 보수의 총액을 전년도 중 직장가입자가 그 사업장등에 종사한 기간의 개월수로 나눈 금액을 매년 보수월액으로 결정한다. 다만, 사용자가 그 사업장등의 해당 연도 보수의 평균 인상률 또는 인하율을 공단에 통보한 경우에는 본문에 따라 계산한 금액에 그 평균 인상률 또는 인하율을 반영하여 산정한 금액을 매년 보수월액으로 결정한다.
The Corporation shall determine the monthly salary each year by dividing the total amount of remuneration notified under Article 35 by the number of months the insured person was employed at the workplace, etc. during the preceding year. However, if the employer notifies the Corporation of the average rate of increase or decrease in remuneration for the relevant year at the workplace, etc., the monthly salary shall be determined each year by reflecting that average rate of increase or decrease in the amount calculated according to the main sentence.
사용자는 해당 직장가입자의 보수가 인상되거나 인하되었을 때에는 공단에 보수월액의 변경을 신청할 수 있다. 다만, 상시 100명 이상의 근로자가 소속되어 있는 사업장의 사용자는 다음 각 호에 따라 공단에 그 보수월액의 변경을 신청하여야 한다. <개정 2015.12.22>
1. 해당 월의 보수가 14일 이전에 변경된 경우: 해당 월의 15일까지
2. 해당 월의 보수가 15일 이후에 변경된 경우: 해당 월의 다음 달 15일까지
If the remuneration of the insured person is increased or decreased, the employer may apply to the Corporation for a change in the monthly salary. However, in the case of workplaces where 100 or more employees are constantly employed, the employer shall apply to the Corporation for a change in the monthly salary according to the following subparagraphs. <Amended by Dec. 22, 2015> 1. If the remuneration for the month is changed before the 14th of the month: By the 15th of that month. 2. If the remuneration for the month is changed after the 15th of the month: By the 15th of the following month.
공단은 사용자가 제35조에 따른 통보를 하지 아니하거나 통보 내용이 사실과 다른 경우에는 법 제94조에 따라 그 사실을 조사하여 보수월액을 산정ㆍ변경할 수 있으며, 제2항에 따른 보수월액의 변경신청을 받은 경우에는 보수가 인상된 달 또는 인하된 달부터 보수월액을 변경할 수 있다.
If the employer does not provide the notification under Article 35, or if the content of the notification is different from the facts, the Corporation may investigate the facts in accordance with Article 94 of the Act and calculate or change the monthly salary. If the Corporation receives an application for a change in the monthly salary under paragraph ②, it may change the monthly salary from the month in which the remuneration was increased or decreased.
직장가입자가 둘 이상의 건강보험 적용 사업장에서 보수를 받고 있는 경우에는 각 사업장에서 받고 있는 보수를 기준으로 각각 보수월액을 결정한다.
If an insured person receives remuneration from two or more health insurance-covered workplaces, the monthly salary shall be determined based on the remuneration received from each workplace.
직장가입자의 보수월액을 제33조부터 제38조까지의 규정에 따라 산정하기 곤란하거나 보수를 확인할 수 있는 자료가 없는 경우 보수월액의 산정방법과 보수의 인상ㆍ인하 시 보수월액의 변경신청 등 필요한 사항은 재정운영위원회의 의결을 거쳐 공단의 정관으로 정한다.
If it is difficult to calculate the monthly salary of the insured person in accordance with Articles 33 to 38, or if there is no data to confirm the remuneration, the method of calculating the monthly salary and other necessary matters, such as applying for a change in the monthly salary when remuneration is increased or decreased, shall be determined by the Corporation's articles of association after deliberation by the Financial Management Committee.
