제69조 도로공사의 신고 및 안전조치 등

도로관리청 또는 공사시행청의 명령에 따라 도로를 파거나 뚫는 등 공사를 하려는 사람(이하 이 조에서 "공사시행자"라 한다)은 공사시행 3일 전에 그 일시, 공사구간, 공사기간 및 시행방법, 그 밖에 필요한 사항을 관할 경찰서장에게 신고하여야 한다. 다만, 산사태나 수도관 파열 등으로 긴급히 시공할 필요가 있는 경우에는 그에 알맞은 안전조치를 하고 공사를 시작한 후에 지체 없이 신고하여야 한다.
A person who intends to carry out construction, such as digging or breaking the road, under the order of the road management authority or the construction executing authority (hereinafter referred to as the "construction executor" in this Article) shall report the date and time, construction section, construction period, method of execution, and other necessary matters to the head of the competent police station three days before the commencement of construction. Provided, that in cases where urgent construction is necessary due to landslides, water pipe bursts, etc., the construction executor shall take appropriate safety measures and report without delay after commencing construction.
관할 경찰서장은 공사장 주변의 교통정체가 예상하지 못한 수준까지 현저히 증가하고, 교통의 안전과 원활한 소통에 미치는 영향이 중대하다고 판단하면 해당 도로관리청과 사전 협의하여 제1항에 따른 공사시행자에 대하여 공사시간의 제한 등 필요한 조치를 할 수 있다.
If the head of the competent police station determines that traffic congestion around the construction site is expected to increase to an unforeseeable level and that the impact on traffic safety and smooth flow is significant, he/she may, after prior consultation with the relevant road management authority, impose necessary measures such as restrictions on construction hours on the construction executor under paragraph ①.
공사시행자는 공사기간 중 차마의 통행을 유도하거나 지시 등을 할 필요가 있을 때에는 관할 경찰서장의 지시에 따라 교통안전시설을 설치하여야 한다.
The construction executor shall install traffic safety facilities in accordance with the instructions of the head of the competent police station when it is necessary to guide or direct the passage of vehicles during the construction period.
공사시행자는 공사기간 중 공사의 규모, 주변 교통환경 등을 고려하여 필요한 경우 관할 경찰서장의 지시에 따라 안전요원 또는 안전유도 장비를 배치하여야 한다. <신설 2020.10.20>
The construction executor shall, if necessary, in consideration of the scale of construction, the surrounding traffic environment, etc., during the construction period, deploy safety personnel or traffic guidance equipment in accordance with the instructions of the head of the competent police station. <Newly enacted 2020.10.20>
제3항에 따른 교통안전시설 설치 및 제4항에 따른 안전요원 또는 안전유도 장비 배치에 필요한 사항은 행정안전부령으로 정한다. <신설 2020.10.20>
Matters necessary for the installation of traffic safety facilities under paragraph ③ and the deployment of safety personnel or traffic guidance equipment under paragraph ④ shall be prescribed by the Ordinance of the Ministry of the Interior and Safety. <Newly enacted 2020.10.20>
공사시행자는 공사로 인하여 교통안전시설을 훼손한 경우에는 행정안전부령으로 정하는 바에 따라 원상회복하고 그 결과를 관할 경찰서장에게 신고하여야 한다. <개정 2013.3.23, 2014.11.19, 2017.7.26, 2020.10.20>
If the construction executor damages traffic safety facilities due to construction, he/she shall restore them to their original condition and report the results to the head of the competent police station in accordance with the Ordinance of the Ministry of the Interior and Safety. <Amended 2013.3.23, 2014.11.19, 2017.7.26, 2020.10.20>
